Terms of Service

1. Acceptance of Terms

By accessing or using Oblivery.com ("the Service"), including our website and Discord bot, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Oblivery.com is a free community platform for iRacing livery painters, providing:

  • A gallery to browse and showcase paint liveries, helmets, and suits
  • User profiles displaying painter collections and statistics
  • Community statistics and leaderboards
  • A decals showcase for logo and artwork management
  • A Discord bot for community notifications about new paints and activities

The Service integrates with Trading Paints to display publicly available paint data.

3. Eligibility

You must be at least 13 years old (or 16 in some EU countries) to have an account and use the Service. By using an account, you represent that you meet this age requirement. If you are under the required age, please do not use the Service.

4. User Accounts

4.1 Account Creation

Accounts are created by administrators for authorized community members. There is no self-registration. If you are granted an account, you agree to:

  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these terms, or for any other reason, including conduct that is harmful to the community or the Service.

5. Discord Bot

Our Discord bot operates within Discord servers to provide notifications about community activities. By using the Discord bot:

  • You agree to Discord's Terms of Service and Community Guidelines
  • Server administrators are responsible for configuring bot permissions appropriately
  • The bot may mention users in notifications if configured to do so by server administrators
  • We are not responsible for how server administrators configure or use the bot

6. User Content

6.1 Content Ownership

Paint liveries displayed on the Service remain the intellectual property of their respective creators. We display publicly available data from Trading Paints with the purpose of showcasing community work.

6.2 Uploaded Content

If you upload content (such as logos or decals), you:

  • Retain ownership of your content
  • Grant us a license to display, store, and distribute that content through the Service
  • Warrant that you have the right to upload and share such content
  • Agree not to upload content that infringes on third-party intellectual property rights

6.3 Prohibited Content

You agree not to upload or share content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights
  • Contains malware or malicious code
  • Violates any applicable laws or regulations

7. Copyright Infringement and Takedown Policy

We respect the intellectual property rights of others. If you believe that content on Oblivery.com infringes upon your copyright, please notify us by sending an email to legal@oblivery.com with the following information:

  • A description of the copyrighted work that you claim has been infringed
  • The URL or other specific location on the Service of the material you claim is infringing
  • Your contact information (name, address, email address)
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

Upon receipt of a valid notice, we will take appropriate action, which may include removal of the challenged content from the Service.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Impersonate any person or entity
  • Collect or harvest user data without consent

9. Third-Party Services

The Service integrates with third-party services including:

  • Trading Paints: We fetch and display paint data from Trading Paints
  • Discord: Our bot operates on Discord's platform
  • AWS: We use Amazon Web Services for file storage

Your use of these services is subject to their respective terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

10. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

iRacing and Trading Paints are trademarks of their respective owners. We are not affiliated with, endorsed by, or sponsored by iRacing or Trading Paints.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted or error-free
  • Data displayed will be accurate or up-to-date
  • The Service will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

This is a free community project with no commercial intent. We provide the Service in good faith for the benefit of the simracing community.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

14. Changes to Terms

We may update these Terms of Service at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.

15. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

Any legal suit, action, or proceeding arising out of these Terms of Service shall be instituted in the competent courts of the Netherlands.
